These terms and conditions (this "Agreement") govern your use of our website and services. By using this website and services, you agree to this Agreement.  This Agreement is subject to change at any time and we will ensure that the current version is always available on our website.

Definitions:

LOOTB is Learn Out of The Box

The Assessor is Mrs. Jo Packard who holds a BA (Hons) B.ED, DFE Qualified Teaching Status, Registered with DFE Teaching Regulatory AgencyOCR L5 Dip. in teaching learners with Dyslexia/SpLD (Primary), Ofqual SpLD Qualified Teaching Status and an Enhanced DBS/Portable/Unsupervised

Client is the person or persons who request, arrange and pay for the service whether it is a SENCO/Charitable Trust/Sponsor

Pupil - is the person receiving an assessment from LOOTB
Consultancy is the provision of education advice or consultation.

1. Services

1.1 School and Family Questionnaires need to be fully and honestly completed before any Non-Diagnostic Assessment can take place.

1.2 The Non-Diagnostic Assessment session lasts up to 2-hours with a mini break. 

1.3 The Non-Diagnostic Assessment will provide The Assessor with specific educational indicators of a child’s strengths and weaknesses covering key foundation skills in English and Maths, phonological awareness and working and short-term memory.

1.4 The Non-Diagnostic Assessment services are provided for informational and teaching purposes only. They are not a substitute for a formal diagnosis and you should consult with your SENCO/Head or educational provider if you have any more complex concerns about the Pupil of concern.

2. Disclaimer

2.1. The Assessor does not hold nor imply that they hold an 'Assessment Practicing Certificate' (APC) in order to to formally assess, diagnose and make recommendations for exam access arrangements.

2.2. The Assessor is not acting in the capacity of a diagnostic or medical professional.

2.3. The Client has chosen to work with The Assessor and participate in an assessment programme voluntarily.

2.4. The Client accepts full responsibility for all decisions and courses of actions that they take.

 

3. Responsibility

3.1. The Assessor will do everything possible to support your child in achieving achievable results with desired outcomes in order to write the report and IEP in order to support their learning.

3.2. The Assessor will work with the Client to identify solutions and offer suggestions, options and advice based on their professional experience and training.

4. Payment, Refunds & Cancellation Policy

4.1 If the Client wishes to cancel the assessment and/or any payments made within 5 business days of the start date of our services, they may do so by notification in writing and, in such circumstances, LOOTB will provide them with a full refund of any monies paid. Refunds will not be provided for services that have already commenced.

4.2. All assessment sessions are scheduled in advance by direct agreement between the Client and Jo Packard. If for any reason the Pupil cannot attend an assessment session, it can be cancelled within 24 hours and rescheduled. Any session cancelled with less than 24 hours notice will be forfeited.  All notice of cancellation must be made in writing by WhatsApp, text or email to Jo Packard and the Client is responsible for rescheduling. The assessment is individually created and cannot be altered or partially completed in any way. 

4.3 Rights are reserved to cancel bookings for reasons of viability, adverse weather conditions, illness, or other unforeseen reasons, or if it is believed there is any reputational risk to the company. In such cases an alternative date will be arranged, or a refund given.

5. Assessment & Assessment Changes

5.1 Before a Non-Diagnostic Assessment can take place, School and Family Questionnaires need to be honestly completed by the Client and Class Teacher. This is essential information which is used to inform the assessment. Follow up phone calls may also be made to support this information.

5.2 The assessment will be carried out at an agreed venue and time.

5.3 The assessment will take place with the Learner, on a one-to-one basis, in a quiet, private room for the duration of the set time. If there is deemed to be a relevant need (i.e SEND) for the child to be accompanied, this needs to be discussed and agreed, prior to assessment and reference to this will be made in the body of the written report. 

5.4 Unless otherwise agreed, a report will be written within 7-working days from the assessment date. It will be emailed to the Client. Any evidence will be sent by post recorded delivery or handed over in person if local.

J5.5 The Assessor will be available to discuss the report if deemed necessary. There is no charge for feed back to the Client. A fee may be charged for discussions with interested third parties, depending on the circumstances. This may be face to face, telephone, or video call. Any fees will be charged at the consultation rate of £50 per hour.

5.6 Learners under 18 will under no circumstances be left unattended, or with any unknown adult during an assessment.

5.7 Appointment times should be adhered to. In the event of appointments not being attended on time, the session will end at the arranged time and charged at the same rate.

5.8 The Assessor reserves the right to change or modify any assessments as deemed necessary. Any such change will be made in consultation with the Client.

 

6. Absence

Due to the nature of a custom-made assessment:

6.1 In the event that the Assessor is unable to provide the Services due to illness, incapacity or family emergency, she will endeavour to find an alternative date to provide the Services subject to the Client’s approval (which shall not be unreasonably withheld).

6.2 Should the Assessor not receive a call/phone message/text/email from the Client before 9am on the day of the assessment, 50% of the fee will apply. A 100% new fee will be charged for the pre-planned assessment to take place, subject to availability, and should be transferred by BACs to the account on the new Invoice.

6.3 Should the Client forget/not call the Assessor or Pupil not turn up to for the arranged assessment, 50% of the fee will apply. A 100% new fee will be charged for the pre-planned assessment session to take place, subject to availability.


7. Intellectual Property

All content on Jo Packard's website, www.learnoutofthebox.co.uk, including text, graphics and logos, is the property of Jo Packard and is protected by copyright and other intellectual property laws. You may not reproduce, modify, distribute or sell any of our content without prior written consent.

8. Limitation of Liability

8.1 .Jo Packard’s services are provided on an "as is" and "as available" basis. She makes no representations or warranties of any kind, express or implied, as to the operation of her website, services, or products.

8.2 Jo Packard will not be liable for any damages of any kind arising from the use of our website and services, including but not limited to direct, indirect, incidental, punitive and consequential damages.

8.3 To the extent permitted by law, Jo Packards liability for any claims arising out of or related to this Agreement or our services or products will be limited to the amount paid by you for the services or products in question.

 

9. Expenses
9.1 All expenses for assessment materials will be covered in the agreed fee.
9.2 All prices are inclusive of mileage within a 10- mile radius of the Assessor’s home, unless otherwise specified.
9.3 Mileage if charged will be at a rate of £0.45p per mile.

 

10. Code of Ethics
10.1 Jo is a member of PATOSS (Professional Association of Teachers of Students with Specific Learning Difficulties). Please refer to the PATOSS Code of Ethics.

 

11. Complaints
11.1 If you have any concerns about any practice or incident relating to LOOTB, please contact Jo in the first instance for an informal discussion. If this does not solve your concern, you may refer to the PATOSS complaints procedures.

11.2 Jo Packard (owner of LOOTB) holds Public Liability Insurance and Indemnity Insurance with Simply Business (Financial Services Registration No.313348) underwritten by DAS Legal Expenses Insurance Company Limited is authorised by the Prudential Regulation Authority and regulated by the Financial Conduct Authority (FRN202106).

 

12. Terms and Conditions for Publications
12.1 Any and all intellectual property rights in and relating to LOOTB are owned by Jo Packard.

12.2 Unauthorised use of those Materials including reproduction, storage, modification, distribution, or republication, without the prior written approval of Jo Packard is strictly prohibited and may result in prosecution.

12.3 Names and logos of LOOTB may not be used without the prior written approval of Jo Packard

13. Miscellaneous

13.1 This Agreement constitutes the entire agreement between you and us regarding your use of our website and services. By entering into an agreement to use our services either or through payment to Jo Packard, you agree to abide by the terms and conditions of this Agreement

13.2. If any provision of this Agreement is found to be invalid or unenforceable at law, the remaining provisions will remain in full force and effect.

13.3. Failure by us to enforce any provision of this Agreement will not be construed as a waiver of that provision and/or our right to enforce it in the future.

13.4 The Services will be carried out by the Assessor with reasonable care, skill and diligence.

13.5 Both Client and Assessor will adhere to Covid-19 Government Guidelines and the Client understands and acknowledges that whilst the Assessor has taken all practical steps to minimise any contagion of COVID-19, the Assessor will not be held responsible if the Pupil becomes infected with the disease.

13.6 The Teacher shall not be liable to the Client for any indirect or consequential loss or damages including, without limitation, loss of business or profits, whether arising from negligence, breach of contract or otherwise.
